1. Acceptance of Terms

By accessing or using Flunnl ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Flunnl is a SaaS platform that provides:

  • Landing page creation and hosting
  • Form building and management
  • Lead capture and storage
  • Lead distribution and routing
  • Analytics and reporting

3. Account Registration

To use the Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your password and account
  • Be at least 18 years of age
  • Be legally authorized to enter into this agreement
  • Notify us immediately of any unauthorized use of your account

4. Your Responsibilities

4.1 Compliance with Laws

You are solely responsible for:

  • Compliance with GDPR, CCPA, and all applicable data protection laws
  • Obtaining proper consent from individuals whose data you collect
  • Providing appropriate privacy notices on your landing pages and forms
  • Honoring data subject rights requests (access, deletion, etc.)
  • Compliance with anti-spam laws (CAN-SPAM, CASL, etc.)

4.2 Prohibited Uses

You may not use the Service to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malware, viruses, or harmful code
  • Engage in fraudulent or deceptive practices
  • Collect data from minors without parental consent
  • Spam or send unsolicited communications
  • Attempt to gain unauthorized access to our systems

5. Data Processing Agreement

By using Flunnl, you acknowledge that we act as a Data Processor on your behalf. You are the Data Controller and are responsible for ensuring your use of the Service complies with applicable data protection laws. We process data strictly according to your instructions through the Service.

6. Payment Terms

6.1 Subscription Fees

You agree to pay all fees associated with your chosen subscription plan. Fees are billed in advance on a monthly or annual basis and are non-refundable except as required by law.

6.2 Payment Processing

All payments are processed securely through Stripe. We do not store your credit card information.

6.3 Price Changes

We may change our pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

6.4 Late Payment

If payment fails, we may suspend your account until payment is received. We reserve the right to terminate accounts with overdue payments.

7. Service Level and Availability

While we strive to provide reliable service, we do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any downtime or service interruptions.

8. Intellectual Property

8.1 Our Property

The Service, including all software, designs, and content, is owned by Flunnl and protected by intellectual property laws. You may not copy, modify, or reverse engineer our Service.

8.2 Your Content

You retain ownership of all content you upload or create using the Service. By using the Service, you grant us a license to store, process, and display your content as necessary to provide the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE PROVIDE THE SERVICE "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS
  • WE ARE NOT LIABLE FOR DATA LOSS OR CORRUPTION (MAINTAIN YOUR OWN BACKUPS)
  • WE ARE NOT LIABLE FOR YOUR FAILURE TO COMPLY WITH DATA PROTECTION LAWS

10. Indemnification

You agree to indemnify and hold harmless Flunnl from any claims, damages, or expenses arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or regulation, or (d) your collection and processing of personal data.

11. Termination

11.1 By You

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period.

11.2 By Us

We may terminate or suspend your account immediately if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Fail to pay fees when due
  • Use the Service in a way that harms us or other users

11.3 Effect of Termination

Upon termination, your access to the Service will cease. We will retain your data for 30 days to allow for account recovery, after which it will be permanently deleted.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts located in [Your Jurisdiction].
